DI 26535.016 Initial Title XVI Notices for Allowances

A. Fully favorable allowances

Title XVI allowance notices are computer generated based upon systems input. The Disability Determination Services (DDS) will make no entry in item 29 of the SSA-831 (Disability Determination and Transmittal). The DDS does not prepare the notice except in situations where an interim notice (SSA-L1157) is warranted. The Field Office (FO) prepares and issues the notice to the claimant after it has been uploaded to the certified electronic folder and stored in the appropriate section. However, if the FO identifies the case as an Electronic Disability Collect System (EDCS) exclusion, resulting in a modular disability folder (MDF) the DDS:

  • attaches an SSA-408 (Route Slip) to the folder; and

  • forwards the folder to the FO advising the FO to prepare and release the notice.

If the case is selected for Quality Assurance (QA) review, process according to the instructions in DI 26535.036.

B. Partially favorable allowances

In Title XVI claims, a partially favorable allowance with an unfavorable onset date is one in which the date of onset is established after the protective filing date, or after the date of filing, if there is no protective filing.

1. Title XVI unfavorable onset date

Title XVI allowance notices are computer generated based upon systems input. The DDS will make no entry in item 29 of the SSA-831. The DDS prepares and releases the interim notice according to the instructions in DI 26535.036 and alerts the FO that further processing is needed via EDCS, or by attaching an SSA-408 (Route Slip) to the paper folder. If the case is selected for Quality Assurance (QA) review, process according to the instructions in DI 26535.036.

2. Closed period allowance

The Disability Determination Service (DDS) prepares a personalized explanation with an interim notice for initial Title II and Title XVI closed period and unfavorable onset date allowances according to the instructions and procedures in the following:

  • DI 26530.005, Cases Requiring a Personalized Disability Explanation

  • DI 26530.015, Personalized Explanation in Initial Closed Period, Unfavorable Onset Date, and DWB Allowances Where the Month Of Entitlement is Restricted to January 1991 Under P.L. 101-508

  • DI 81020.130, Electronic Case Closure
