DI 52120.280 Wyoming Workers’ Compensation (WC)

A. Types of WC payments

1. Temporary Total (TT)

  • Paid as a monthly rate; ½ on the 15th of the month and ½ on the 30th of the month.

  • Limited to 24 months; additional TT up to 12 months may be awarded.

  • Ceases if worker accepts employer’s offer of temporary light duty work (see DI 52120.280A2. below).

  • Reduced by 2/3 if the worker refuses an employer’s light duty offer.

2. Temporary partial (TP)

  • Paid monthly

  • Paid as a wage supplement when worker accepts employer’s offer of temporary light duty work; TP + wages will exceed TT rate.

3. Permanent Total (PT)

  • Paid monthly; may be paid partly or wholly in a lump sum.

  • Maximum period of 80 months; may apply for an extension.

4. Permanent Partial Indemnity (PPI)

  • Paid monthly; cannot be paid as a lump sum.

  • In addition to PPI, a separate physical impairment award, not exceeding 6 months, may be made due to a permanent disfigurement due to an injury to the face or head.

5. Permanent Partial Disability (PPD)

  • Paid monthly; may be paid partly or wholly in a lump sum.

  • Paid only if PPI previously awarded; worker must apply for PPD.

B. Cost-of-living adjustments (COLAs)

Wyoming did not provide for COLA increases for any type of WC payment until July 1, 2009. For permanent total (PT) awards first made at least one year before July 1, a COLA not to exceed three percent is given annually effective July 1.

C. Attorney fees

The State does not require authorized attorney fees. However, if a hearings officer, district court or Supreme Court sets a fee amount, the attorney or representative may not charge any additional fee.

D. Retirement insurance benefit (RIB) considerations

Wyoming does not offset its WC for SSA retirement benefits.
