SI 00501.417 Blind or Disabled Children of Military Personnel Stationed Overseas - Informing Recipients of Changes

A. Procedure - Use of Manual Notices

Manual notices must be used until automated notices are available. The FO with jurisdiction at the time the change is made is responsible for issuing the notice appropriate to the changes processed by that office. Language for all notices is in NL 00804.174.

B. Procedure - Suppress Automated Notices

When you make any input that would normally generate a notice, suppress notices using instructions in SM 01301.675D. Suppress Goldberg v. Kelly adverse action notices using instructions in SM 01305.530.

C. Procedure - Giving Appropriate Notice

1. Adverse Actions

Use the form SSA-L8155-U2, Notice of Planned Action, to inform the recipient of any adverse changes. In addition to the more usual types of adverse actions (e.g., suspension of benefits, benefit reduction, termination of benefits), be sure to cover the points below as appropriate:

  • SSI payments are suspended for failure to confirm eligibility (N05).

  • The child's SSI benefits are being reduced because they no longer live in a State which pays a supplement to SSI recipients.

  • The child's eligibility for Medicaid may be affected because they no longer live in a State which provides coverage. For further information, contact the Department of Social Services/Public Welfare in the State of last residence.

  • The child is not a United States citizen and, therefore, not eligible to receive SSI while overseas.

  • The child's SSI benefits are being stopped because they are no longer living with a parent who is a member of the armed forces, and the child is still outside the United States.

  • The child's SSI benefits are being stopped because the parent is no longer serving on permanent duty ashore overseas in the armed forces, and the child is still outside the United States.

  • The child's SSI benefits are being stopped because they are no longer a “child.”

2. Other Situations Requiring Notification

a. Initial Claims Allowances

Use the SSA-8025-U2, Notice of Payment Decision, and language from NL 00804.174.

b. No Payments Are Due

Use the SSA-L8166-U2, SSI Notice, and language from NL 00804.174.

c. Only Retroactive Payments Being Made

Use the SSA-L8100-U2, SSI Notice of Revised Determination, and language from NL 00804.174.

d. Other Changes

Select stock language as appropriate from NL 00804.174 and use the applicable form below to notify recipients of other changes:

  • SSA-L8151-U2, Notice of Change;

  • SSA-L8165-U2, Notice of Decision.

e. Points Appropriate to the Case

As appropriate to the individual case, cover the points in SI 00501.417C.1. in any notice you send.
