Paragraph TRF001 (INELIGIBLE DUE TO TRANSFERRED RESOURCE)

When Used: This paragraph is used to inform an individual that the transfer of a resource will result in a period of ineligibility for SSI. This paragraph is not used for cash transfers.

TRF003 (UNDUE HARDSHIP DEFINITION)

When Used: This paragraph is used to inform the individual that, despite the resource transfer, he or she may be eligible for SSI if not getting SSI would cause undue hardship. This paragraph also explains the term “undue hardship.”

When Used: These paragraphs and the accompanying caption are used whenever a manual notice is sent to an individual about a transfer of resources determination. These paragraphs explain the transfer of resources provision and how it affects SSI eligibility. These paragraphs are the same on every manual notice, so fill-ins are not needed.

How Transferring A Resource Affects SSI Eligibility

 

TRF019 (RESOURCES DEFINITION)

Resources are things that a person owns such as cash, stocks, bank accounts, certain types of life insurance, buildings, and land.

 

TRF020 (PERIOD OF INELIGIBILITY RULE)

Giving away a resource or selling it for less than it is worth can make a person ineligible for SSI for up to 36 months. The number of months the person is ineligible depends on the dollar value of the resource that was sold or given away.

 

TRF021 (UNDUE HARDSHIP EXCEPTION)

A person who gives away a resource or sells it for less than it is worth may be ineligible for SSI unless not getting SSI would cause undue hardship. Undue hardship means not being able to afford food and shelter.

 

TRF022 (OTHER EXCEPTIONS TO INELIGIBILITY)

When a resource is transferred, a person still may be eligible for SSI if the person can show that:

  • the resource was not transferred in order to become eligible for SSI; or

  • the transferred resource has been returned to that person; or

  • the person intended to transfer the resource for something of the same value.
