SI 02003.030 IAR Notices to the Individual for Exception Cases and Proration Cases

A. Policy for notices for IAR cases

SSA must inform individuals that we paid their retroactive check to the State because of IAR involvement.

B. Process for automated IAR notices for IC and PE cases

Unless we suppress the notice, the system automatically generates an SSA-L8025 (Award Notice) along with paragraph SSI009 (formerly #1046) to a claimant who qualifies for SSI payments and whose retroactive check is sent to the State that provided interim assistance in initial claims (IC) and post-entitlement (PE) situations.

C. Procedure for manual IAR notices IC and PC

Follow these instructions to prepare a manual IAR notice:

  • Add paragraph SSI009 (formerly #1046) to the SSA-L8025. For IAR notice language, see NL 00804.125; and

  • Send the individual an SSA-L8165 (SSI Important Information) to inform the claimant that the retroactive check goes to the State when the individual's recurring SSI check precedes the retroactive check.

NOTES:

  • The SSA-L8165 does not include appeal rights because it is not an initial determination subject to appeal.

  • If you send the notice to a claimant, beneficiary, or representative payee who alleges being blind or visually impaired, follow the special notice procedures in NL 01001.010.
