SI 02004.120 Immediate Payments in Concurrent Cases

A. PROCEDURE

1. Retroactive Benefits and Windfall Offset

If retroactive benefits are due and windfall offset applies (see GN 02610.005 ff.), first compute the windfall offset. This determines the Title XVI and Title II amounts due. Use these amounts to compute the IP.

2. Making the IP Payment

Make the IP from the program which can pay the full IP amount.

If . . .

Then . . .

Both Title II and Title XVI can pay the full IP amount

Pay the IP from Title II funds.

Title II equals or exceeds IP amount

Pay a Title II IP (see RS 02801.001).

Title II is less but Title XVI equals or exceeds IP amount

Pay a Title XVI IP.

Both Title II and Title XVI are less than IP

Pay the Title II IP first and then the Title XVI IP up to the IP maximum or the amount of total unpaid benefits, whichever is smaller.
