SI 04030.030 Title XVI and Concurrent Non-Medical Appeals - Instructions for Forwarding Hearing Requests to the Hearings Level Using the Electronic Non-Medical Application

A. General information about forwarding Title XVI or concurrent (Title II/Title XVI) non-medical hearing requests using the Electronic Non-Medical (ENM) application

Field office (FO) technicians will use the instructions in this section to send a Title XVI or concurrent (Title II/Title XVI) common issue non-medical hearing request to the hearings level using the ENM application.

Technicians will create, upload documents, edit, and change the case jurisdiction in the ENM application, and route all Title XVI or concurrent (Title II/Title XVI) non-medical appeals cases to the Special Review Cadre (SRC), office code 5ZU, except for class action cases. Class action cases will continue to be routed to the local jurisdictional hearing office. For instructions on ENM case creation, upload instructions, and troubleshooting, see GN 03103.080B.

Once created, ENM is the official folder of record for non-medical cases.

The terms “hearing request” and “HA-501” are used interchangeably throughout these instructions. These instructions presume:

  • •

    The beneficiary or recipient received a reconsideration determination, if procedurally applicable. For more information on the hearing process, see SI 04030.020;

  • •

There is a completed HA-501 (Request for Hearing by Administrative Law Judge) or i501, or a written document that disagrees with the prior determination. For more information on completing the HA-501, see GN 03103.020. For more information on iAppeals non-medical, see SI 04005.040; and

  • •

When applicable, there is a completed Electronic Non-disability Summary Sheet (eNDSS). For instructions on completing the eNDSS, see GN 03103.130B.

Other Program Operations Manual System (POMS) sections include instructions for processing hearing requests on the following situation:

  1. 1.

    Disability

Process disability hearing requests for Title II only, Title XVI only, or concurrent (Title II/Title XVI) per DI 12010.010, DI 81010.085, and DI 81010.150.

  2. 2.

    Title II only - non-medical

Process non-medical hearing requests for Title II only per GN 03103.080.

  3. 3.

Medicare Part A (Hospital Insurance (HI)), Part B (Supplementary Medical Insurance (SMI)), and Income-Related Monthly Adjustment Amount (IRMAA)

    • •

Process hearing requests for Medicare Part A and Part B per GN 03108.210.

    • •

Process hearing requests for IRMAA per HI 01140.001.

  4. 4.

    Representative payee misuse

Process hearing requests for payee misuse per the instructions in GN 00604.064G.

  5. 5.

    No reconsideration determination

If the claimant insists on filing a hearing request before receipt of a reconsideration determination, process the hearing request per SI 04030.020B.4.

  6. 6.

    Late hearing request

When a claimant submits a hearing request late, see GN 03101.020D. Do not delay forwarding a late hearing request to the hearings level while awaiting receipt of a good cause statement.

B. Servicing FO's instructions for forwarding the HA-501 to the hearings level

For Title XVI non-medical hearing requests, the administrative law judge (ALJ) must make a decision within 90 days of the date that we received the hearing request. The FO will follow the instructions below for sending Title XVI only or concurrent (Title II/Title XVI) common issue non-medical hearing request using the ENM application to the SRC within 15 calendar days of the date that the FO received the hearing request. The FO must notify the hearings level if the FO will not be able to forward the hearing request and complete eNDSS within 15 calendar days.

1. FO to the hearings level

Within 15 calendar days of receipt of the HA-501/i501, the FO will:

  1. a.

Build the appeal request data to the Supplemental Security Record (SSR) by selecting “appeal” from Supplemental Security Income (SSI) Main Menu (MSSI). If the case is non-Modernized SSI Claims (non-MSSICs) (cases never processed in the SSI Claims system or where there is not an active claim iteration on the claim file), use the Direct Update SSR (DSSR) process.

NOTE: On the Jurisdiction and Status (AJAS) page, enter 5ZU (the office code for the SRC) for “Claim Preferred Office,” unless a class action. For class action cases, enter the local jurisdictional hearing office code. For more information on AJAS page, see MS 04420.023. On the MCS Claim Movement/WMS Clearance (CMWM) screen, enter 5ZU for “Transfer To.” For more information on CMWM screen, see MS 03520.003.

  2. b.

Gather proper documents from electronic repositories such as the Evidence Portal (EP), Online Retrieval System (ORS), and the paper folder, if needed. Pay attention to Personally Identifiable Information (PII), only include documents and queries relevant to the claimant. The documents include, but are not limited to:

    • •

ii. Title II and Title XVI Payment Status,

iii. Title II benefits continue until the hearing decision and advance notice date - ensures correct termination of the Title II benefits and HI/SMI.

    • •

      Relevant queries, including earning queries.

NOTE: All information for the non-medical appeal should be stored in ENM. Do not send a paper folder containing a non-medical appeal to the hearings level.

  3. c.

Follow instructions in GN 03103.080B.1 through GN 03103.080B.3 to create the case in ENM and upload proper documents from SI 04030.030B.1.b above into ENM.

  4. d.

Prepare a completed eNDSS report, including any additional queries not already listed in SI 04030.030B.1.b above, save the report as a PDF file, and upload it into ENM. For instructions on completing and saving the eNDSS, see GN 03103.130B and Saving a Document to PDF guide.

  5. e.

Send the case to the SRC, office code 5ZU. For class action cases, route to the local jurisdictional hearing office.

  6. f.

Send an email to the SRC mailbox ^DA DICompliance ENM SSI Non Dib Hearings to notify SRC that you have created the case, uploaded documents, and changed jurisdiction in ENM. For class action cases, send an email to the local jurisdictional hearing office, see the "ENM Mailboxes" Excel spreadsheet in Electronic Non-Medical Desk Guide.

    • •

In the email to the hearings level, include any applicable special case characteristics such as multiple appeals issues, dual entitlement, auxiliary case, etc.

    • •

      See following example:

      To:

^DA DICompliance ENM SSI Non Dib Hearings

      CC:

<Division Mailbox> (Refers to Sender’s site location email address, i.e., FO mailbox.); Sender’s email address

      Subject:

ACTION: Title (XVI or Concurrent) Non-Medical Appeal

      Body:

Please refer to the ENM case created for SSN xxx-xx-xxxx. Please return decision to WorkTrack number (xxx) xxx-xxxx (Title XVI) and Paperless number (xxx) xxx-xxxx (Title II portion of concurrent case).

  7. g.

Upload HA-501/i501, the copy of eNDSS report, and any new evidence that the claimant submits with the appeal into EP.

NOTE: For any case older than 180 days, if possible, technicians should confirm key information prior to transferring to the hearings level:

    • •

      Claimant’s mailing address;

    • •

Claimant’s valid contact information, including phone number and email address; and

    • •

Any updated evidence that may have been submitted since the last decision.

2. The hearings level receives the hearing request from the FO

When the hearings level receives the hearing request from the FO, the hearings level will:

  1. a.

Ensure the request for hearing and required documents are included with the ENM case.

  2. b.

Establish the case in the applicable case processing system.

  3. c.

Exhibit the case folder and take appropriate actions (i.e., ALJ holds hearing, renders a decision, and updates ENM).

  4. d.

The hearings level support staff sends Title XVI decision documents to the local office via WorkTrack number and Title II portion of concurrent cases to the appropriate PC Paperless number, then closes the case in ENM. In addition, the hearings level support staff emails the decision to the PC’s division mailbox, which can be located in DOORS based on the SSN.

NOTE: FO technicians effectuate the Title XVI decision, while PC technicians effectuate the Title II portion of concurrent cases. However, if there are issues that were not before the ALJ and require additional FO or PC actions, the decision should be routed to the FO to determine if any FO action is needed on the Title II portion before transferring the case to the PC. For example, if the ALJ determines SGA is not applicable and a medical determination is still needed, the decision would be forwarded to the FO for DDS to make a medical determination, since this issue was not before the ALJ. Decisions will be routed to the FO for review to determine if any FO action is required on the Title II portion of the non-medical hearing request before transferring the case to the PC for further action.

3. How to handle misrouted hearing requests, missing ENM cases, or incomplete records

a. Title II only non-medical hearing requests received in the FO

The FO is responsible for processing hearing requests for the Title II exceptions described in GN 03103.080A.1. If a Title II only non-medical hearing request received in the FO is not one of those exceptions, the FO follows the instructions in GN 03103.080E.1 for forwarding the misrouted hearing request to the jurisdictional PC.

b. Plan to Achieve Self-Support (PASS) hearing requests received in the FO

If a PASS hearing request is received in the FO, within 5 business days of receipt of the HA-501/i501, the FO forwards the misrouted hearing request to the PASS Cadre via WorkTrack. The PASS Cadre will prepare the eNDSS, create the ENM, and transfer the ENM to the SRC. The PASS Cadre will also email the SRC notifying them the case has been created and transferred to the SRC.

After forwarding the hearing request to the PASS Cadre, the FO will send an email with the HA-501/i501 attached to SRC mailbox ^DA DICompliance ENM SSI Non Dib Hearings to notify SRC of the existence of the appeal.

  • •

    See following example:

    To:

^DA DICompliance ENM SSI Non Dib Hearings

    CC:

<Division Mailbox> (Refers to Sender’s site location email address, i.e., FO mailbox.); Sender’s email address

    Subject:

    ACTION: PASS Hearing Request

    Body:

The attached HA-501 Hearing Request for PASS was received in FO and has been forwarded to the PASS Cadre to process. Please contact PASS Cadre (specific contact details based on jurisdiction) for necessary documents. The SRC will receive the case information in the ENM folder from the PASS Cadre.

  • •

Upload the HA-501/i501 into eView or EP as appropriate.

NOTE: If you are a PASS Cadre member who does not have access to ENM, complete a Systems Access Management (SAM) request with your profile code (e.g., 00275 Area Work Incentive Coordinator) and a detailed justification for why you need access. Example of justification: PASS Hearing Requests – To prepare and transfer ENM folders to the SRC to process.

For more information on PASS, see SI 00870.000.

c. Hearing requests forwarded to hearings level without an ENM case or missing required claim documents

If the hearings level receives a request for hearing without an ENM case, or if the ENM case is missing required claim documents listed in SI 04030.020B.1.b above, the hearings level will send an email to the servicing FO mailbox and copy the FO management team requesting the ENM case be created or the required documents be added and forwarded to the hearings level. If there is no response, the ENM case is not established, or the required documents are not added within 5 business days, the hearings level will escalate the request to the Area Director Point of Contact (POC).

d. Hearing request received in the hearing office

If the claimant or representative submits a hearing request to the hearing office, the hearing office will send the hearing request to the servicing FO for processing. The FO should follow the instructions in SI 04030.020B.1 above to create the case, upload documents, edit and change the case jurisdiction in the ENM application, and route the non-medical appeals cases to the SRC.
