GN 01713.135 Offset of Belgian Benefits

A. Introduction

Belgian Social Security benefits are normally reduced by the amount of any other Belgian or foreign Social Security benefit the beneficiary receives.

B. policy

The agreement provides that Belgium will not offset a retirement or survivor benefit if the beneficiary is entitled to the same type of benefit from the United States. For example, Belgium will not offset any retirement benefit it pays by the amount of any U.S. retirement benefit. Additionally, Belgium will not offset any disability benefit it pays by the amount of any Totalization disability benefit paid by the United States. However, Belgium may offset its benefit where the U.S. benefit is not the same type of benefit (e.g., the beneficiary receives a Belgian survivor benefit and a U.S. retirement benefit) or the U.S. disability benefit is not a Totalization benefit.
