GN 03314.145 Disclosure Without Consent to State and Territory Motor Vehicle Administrations (MVA) (or Agents or Contractors on their behalf) and State and Territory Chief Election Officials for Voter Registration Purposes

A. Disclosure policy

Section 303 of the Help America Vote Act (HAVA) requires States to verify voter registration information with State MVA records, and if none exists, with our records. To meet the requirements of HAVA, we developed the Help America Vote Verification (HAVV) system, through which we verify the last four digits of the voter registrant’s Social Security Number (SSN) with State and Territory MVAs. Use of the HAVV system is limited to State and Territory MVAs (or agents or contractors on their behalf) that need SSN verification for voter registration applicants who do not have a driver’s license. State and Territory MVAs that use the HAVV system must have an active data exchange agreement with us, that outlines the terms and conditions of the data exchange. NOTE: The following seven States are exempt from HAVA: Georgia, Hawaii, Kentucky, New Mexico, South Carolina, Tennessee, and Virginia. If one of these States requests verification of the SSN for voter registration purposes, we may verify the full SSN in accordance with section 7 of the Privacy Act (5 U.S.C. § 552a note), as described in section 205(r)(8) of the Social Security Act. Consult with the regional office Data Exchange Coordinator (DEC) and Privacy Act Coordinator (PAC) regarding requests for the full SSN verification for HAVA purposes from exempt States. Additionally, North Dakota is not required to participate in HAVA verifications since the State does not require registration in order to vote.

B. Procedure for handling requests

The last four digit SSN verification service we provide to State and Territory MVAs (or agents or contractors on their behalf) and State and Territory chief election officials, occurs according to the terms and conditions of the data exchange agreement with the State or Territory MVA, as described in GN 03314.145A in this section. Consult the regional office DEC or PAC to determine if we have a data exchange in effect with a particular State or Territory MVA for HAVA purposes.
