DI 10105.905 Taking and Processing Auxiliary Applications Filed After the Benefit Continuation Election (BCE)

A. Field Office (FO) role

The FO will:

  1. Develop the auxiliary claim in the normal manner.

  2. Prepare an A101 Automated Determination of Award , using data from the Master Beneficiary Record (MBR). Enter a remark on the A101-“Child (spouse, mother, father) claim-Hold pending disability decision.”

  3. Advise the applicant in writing that the decision as to whether benefits are payable will be made only after a final decision is made on the number holder’s (NH's) disability.

  4. Adjudicate the A101. Modernized Claims System (MCS) will establish a control and transfer ownership to the PC (See DI 10105.905B. for exception).

B. Childhood Disability Beneficiary (CDB) claim filed after the Benefits Continuation Election (BCE) on disabled Number Holder’s (NH's) Social Security Number (SSN)

Hold subsequent CDB claims in the FO until a final decision is reached on the disabled NH's appeal.

  • If the cessation decision becomes final the FO will process the claim to a denial.

  • If the cessation is reversed, the FO will develop the claim in the normal manner before sending it to Disability Determination Service (DDS) for the disability decision.

NOTE: Claims filed for mother's/fathers benefits at the time the claim is filed should be processed as in DI 10105.901A.
