DI 55075.015 Disputes Between ENs and the PM That Do Not Involve EN Payment Issues
A. Policy – 2-step dispute resolution process
There is a 2-step dispute resolution process available to ENs and the PM for issues that do not involve an EN's request for a milestone or outcome payment.
1. Step 1 – PM's internal grievance procedures
The first step of this dispute resolution process involves an internal grievance procedure that the PM is required to have. If the use of this procedure does not result in a mutually agreeable solution, the PM must refer the dispute to SSA for a decision.
2. Step 2 –SSA review and decision
The decision that SSA makes at the second step of this dispute resolution process is final.
NOTE: The PM will refer the request for SSA review to staff in OESP, where the final SSA decision will be made by the Dispute Resolution Board.
B. Procedure – handling EN questions about disputes with the PM
Field components should refer any EN with a question about a non-payment dispute with the PM to MAXIMUS.
