GN 02413.002 Determining the Acceptability of Gifts to the Government

A. Operating Procedure

  EVENT ACTION
Case 1 Donation due to rumors concerning the lack of soundness of trust funds. Explain trust funds are secure. Accept if individual insists.
Case 2 Donation by representative payee. Develop payee suitability. Accept if suitable.
Case 3 Donor is an SSI recipient. Make personal contact. Advise consequences of excess resources. Accept if individual insists. Do a redetermination per SI 02305.001 ff. (Also consider transfer of resources below fair market value).
Case 4 Donation for a State supplement. Explain that SSA administers State supplements but does not accept gifts for them.

B. Related Operating Procedure

1. QUESTIONABLE OR UNRESOLVED SITUATION

Refer a questionable situation or unresolved issue, e.g., an unacceptable anonymous gift, to the ARC, Programs.

2. OUT OF SERVICE AREA

Refer an out-of-service-area donor to his/her servicing FO for development and processing of the gift.

3. A BEQUEST

Refer a donor who offers a bequest to his/her attorney to have a will drawn up.

4. GIFT TO GENERAL FUND

Refer a donor who offers a gift to the General fund to the Treasury Department.
