VB 00501.001 Representative Payment -- SVB

A. General

Policy for representative payment can be found in detail in GN 00501.000, GN 00502.000, GN 00504.000, and GN 00605.000. Policy for foreign payees is found in GN 00505.000. Generally, the same policy principles apply when determining whether a representative payee is needed and in selecting a payee for a title VIII beneficiary. (See GN 00502.001 and GN 00505.010)

B. Procedure

1. Capability

You should assume an adult beneficiary is capable of managing or directing the management of the benefits to which he or she is entitled unless there are indicators or evidence to the contrary. Refer to GN 00502.020.

If an individual applies for SVB and is currently entitled to RSI/SSI and has a payee, assume the beneficiary will continue to need a payee unless evidence is presented to the contrary. Document the file (SSA-5002 Report of Contact or similar form) that this beneficiary will or will not need a payee appointment for SVB.

2. Direct Payment

If an individual applies for SVB and is currently entitled to RSI/SSI and is receiving and managing his or her own benefits, presume this individual to be capable unless you are presented with information to the contrary.
