VB 01701.030 Reinstatement of Special Veterans Benefits

A. Introduction

This section addresses reinstatement of benefits after we have suspended or terminated Special Veteran Benefit (SVB) payments.

B. Policy for reinstatement after benefit suspension

Reinstatement of an SVB benefit depends on the reason for suspension. Below is a list of the reasons for suspension and the reference to the section that addresses reinstatement.

Refer to SVB – Suspensions, Stop Payments, and Benefit Reductions – Table of Contents VB 01503.000.

1. Cessation of residency outside the United States (loss of foreign residence)

VB 01503.130 – Reinstatement – Foreign Residence Resumed

2. Failure to provide information

Payments may resume once the beneficiary or representative payee provides information needed to determine continuing entitlement for SVB.

3. Whereabouts unknown

  • VB 01503.315 – Whereabouts Development – Beneficiary Located

  • VB 01503.320 – Whereabouts Determined After S06 Processed

4. Check returned for miscellaneous reasons

VB 01503.400 – Check Returned For Miscellaneous Reasons (S07)

5. After a disqualification event occurs

REMINDER: A beneficiary cannot qualify for any month that he or she has been removed or deported from the United States, is a fleeing felon, or lives in a barred country.

C.  Policy for reinstatement after benefit termination

Reinstatement of an SVB benefit depends on the reason for termination. Below is a list of the reasons for termination and the reference to the section that addresses reinstatement. Refer to Termination Events – Table of Contents VB 01505.000.

1. Termination after 12 consecutive calendar months of suspension

Once SVB payments terminate, beneficiaries generally need to file a new application to reestablish SVB entitlement, unless there is a favorable appeal decision or a reopening that reverses the SVB termination.
